Comity of Nations
The Comity of Nations is a universal, unspoken law among sovereign nations. No country is subjected to follow the comity and it is not included in national laws, but it is generally followed out of respect. Basically, a sovereign country will enact laws of another sovereign country if that countries citizen is on their land. An example of the Comity of Nations in action would be if an American tax broker were charged for fraud while they were in France and the French takes over the trial with American law in mind. Whichever court is reviewing a case will not open a case again if it has already been tried and will instead consider several factors to decide whether or not they should use the foreign court. These factors include "fairness and impartiality of that foreign system, the foreign court’s personal jurisdiction over the defendant, the existence of subject matter jurisdiction, and the presence of fraud..."
